Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Draft UFC Gym ("we," "us," or "our") concerning your access to and use of the Draft UFC Gym mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

User Responsibilities

When using the App, you agree to:

• Provide accurate and complete information when required
• Use the App only for lawful purposes and in accordance with these Terms
• Not use the App in any way that could damage, disable, or impair the App
• Not attempt to gain unauthorized access to any part of the App or its related systems
• Not use any automated means to access or use the App
• Not reverse engineer, decompile, or disassemble any part of the App

Fitness and Health Disclaimer

The App provides workout plans, exercise tracking, and fitness-related content for informational purposes only. This content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

• Always consult with a qualified healthcare provider before beginning any exercise program
• Stop exercising immediately if you experience pain, dizziness, or discomfort
• The workout plans and exercises provided may not be suitable for everyone
• You are solely responsible for any health risks associated with using the App
• We do not guarantee any specific fitness results from using the App

Gym Membership

The App may provide features related to gym membership management, including digital check-in passes. Please note:

• The App does not create, modify, or manage actual gym memberships
• Digital passes are subject to acceptance by your gym facility
• We are not affiliated with UFC Gym or any other gym chain unless explicitly stated
• Any issues with gym membership should be addressed directly with your gym

Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by Draft UFC Gym or its licensors and are protected by copyright, trademark, and other intellectual property laws.

User Content

Any content you create, submit, or store using the App (such as workout logs, personal information, or custom schedules) remains your property. However, by using the App, you grant us the right to store and process this content as necessary to provide the App's functionality.

Third-Party Services

The App may contain links to or integrate with third-party websites, services, or applications. We are not responsible for:

• The content, accuracy, or opinions expressed on third-party sites
• The privacy practices of third-party services
• Any products or services offered by third parties
• Any damages or losses arising from your use of third-party services

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Draft UFC Gym, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or property damage
• Any damages arising from your use or inability to use the App
• Any damages arising from unauthorized access to your data

Indemnification

You agree to defend, indemnify, and hold harmless Draft UFC Gym, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Draft UFC Gym is established, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Draft UFC Gym regarding the use of the App and supersede any prior agreements.
